Rulings on waqf contingencies during pandemics

Abstract

This study aims to consolidate the status of the waqf institution in the contemporary context and develop its mechanisms, highlighting its active role in addressing emergencies, crises, and pandemics that the state may face over time. It also seeks to acknowledge the potential for the evolution of this institution and the continuity of its contribution in serving the public interest and achieving the objectives of Islamic law in promoting cooperation and social solidarity. The study further includes an examination of waqf-related contingencies and their rulings when necessary, covering waqf of public funds, the use of waqf revenues during crises, and the modification of the donor’s conditions in accordance with the objectives of waqf and the circumstances of the time. It relies on both inductive and descriptive analytical methods, along with an overview of the contemporary waqf reality, aiming to reach well-founded conclusions that enhance the effective and humanitarian role of the waqf institution.
